JUDGE THROWS OUT BENSON'S REQUEST TO SUPPRESS STATEMENTS

On October, 9, 2008, Mark Benson a former physician charged with killing an Oconomowoc educator and her two daughters appeared before Chief Judge J. Mac Davis. Benson is charged with killing Jennifer Bukosky, her unborn child and her 10 year old daughter, Courtney Bella. Two other children were also injured. Police state Benson was driving while under the influence of prescription drugs.

In court today, Benson's attorney argued to have the voluntary statements Benson provided to Oconomowoc police officers immediately after the crash suppressed. Because Benson was not under arrest at the time these statements were provided Miranda issues were not relevant.

Judge Davis set trial for 4/21/09. The trial date is just 4 days short of the 1 year anniversary date of the crash. Several dates for motions, status calls and deadlines were also scheduled today.
