Mark Benson Remains in Jail

SUMMIT - Busted again.

The man accused of killing a popular teacher, her daughter, and unborn child is back in jail. Thursday afternoon, Judge J. Mac Davis ruled it will take even more money for Mark Benson to bail out of jail again.

Police say Mark Benson was buying drugs and having them delivered to his home. That violates conditions of the half million dollar bail he posted just 26 days ago.

Thursday, Judge J. Mac Davis froze that $500,000 which would require Benson to re-post that money to bail out again. Combined with an increase to Benson's bail amount, it would now cost the former orthopedic surgeon $650,000 to get out on bail.

Benson was arrested April 25, 2008 for driving drugged and smashing into Jennifer Bukosky's car. Bukosky, her daughter Courtney and unborn daughter Sophia were killed in the crash.

Police say Benson was high on a combination of prescription drugs at the time.

His bail was set at $1 million. But a judge reduced that to $500,000 in February of this year. Benson bailed out jail a day later.

As part of his bail conditions, Benson was told he could only obtain prescription drugs from a single local company.

But a delivery driver reportedly told police that Benson was ordering drugs from a Florida company called Palm Beach Pharmaceutical.

"We did that so that someone would know if he was over filling prescription drugs," said Assistant District Attorney Kevin Osbourn.

Investigators intercepted the package, searched it and found 180 syringes, needles and saline solution. The complaint says they also found seven different types of steroids and hormone pills. Investigators believe the company has supplied steroids to professional athletes.

Undercover detectives delivered the package to Benson's home. They came back five minutes later and found he package already open and the prescriptions already in Benson's bathroom.

There's more, police found riffles and 3 handguns, 20,000 rounds of ammunition, explosive devices similar to bombs and a military signal flare.

In a search warrant made public Thursday, guns are described as being under beds and in the basement. The warrant documents also list five switchblade knives found in a closet and nightstand drawer at the house.

Authorities evacuated the home and the Milwaukee County Bomb Squad came in and cleared it out. Benson was arrested.

We asked Benson to comment after court, he declined.
